For NDIS, individuals with limited decision-making capacity may have one or more “nominees” to take on different tasks in planning and managing their plan. It may be advantageous to have more than one candidate (z.B. if a candidate is ill). If there is clear agreement on a decision to be made, that decision is respected, unless NDIA is concerned about the decision (or lack thereof) poses a serious threat to the personal and social well-being of the person with a disability. State and territorial laws on guardianship and administration are applied only in cases of conflict or disagreement between informal aid or in the absence of informal support. Under the NDIS ACT, the NDIA must “take into account” any person already authorized by a guardianship order or other appointment that gives them the power to make decisions in favour of the person with a disability.

An “other appointment” may include a sibling with whom he is named in the name of his brother or sister for Centrelink. For example, if you already have a power of attorney or guardianship or if you are a centrelink candidate, you can easily be nominated as a “candidate” under the NDIS. If not, you can apply to be a candidate. There are two types of nominees and one person can perform both roles however, many people with limited ability can still make certain decisions. Even if you or one of the parents is a common candidate, your brother or sister should be encouraged and supported, if possible, to contribute to discussions about the goals and support they want. A service provider or NDIS representative should be able to assist you in this process. A candidate will be involved in the development of the plan and will supervise and manage current supports. You can also manage the payment of assistance for the financial package that the person with a disability receives.
